If you have been a resident of Georgia
for one year and have suffered a traumatic brain injury you may be
eligible to apply for a grant from the Brain and Spinal Injury Trust
Fund Commission. A grant from the Trust Fund is not intended to be a
permanent source of funding for an individual and is not an
entitlement. Applicant grant requests for funding should be directly
related to the traumatic brain injury."
Georgia voters approved a constitutional
amendment in 1998, known as Senate Bill 110, (O.C.G.A. § 31-18-1 et.
seq.1). This amendment created the Georgia Brain and Spinal Injury
Trust Fund. This legislation was enacted in January of 1999 to
assist persons with traumatic brain injuries or spinal cord injuries
offset the high costs of needed services through the addition of a
10% surcharge on all DUI fines. These funds are collected on monthly
basis and deposited with the Treasury Department in a separate Brain
and Spinal Injury Trust Fund account.
Georgia law (O.C.G.A. § 31-18-2),
defines “brain injury” as a traumatic injury to the brain, not of a
degenerative or congenital nature, but arising form a blunt or
penetrating trauma or form acceleration-deceleration forces.....”
Further, O.C.G.A. § 31-18-3 instituted reporting procedures for
health care providers to report traumatic brain injuries or spinal
cord injuries to the State of Georgia Brain and Spinal Cord Injury
Trust Fund Commission.
